Acceptance of Terms

By accessing or using Risevu (the “Service”), operated by Everyday Creative Works LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free tier and paid subscribers.

Description of Service

Risevu is a career operating system that helps knowledge workers capture professional accomplishments, translate them into business impact statements, and build a portfolio of documented proof. The Service is provided as a subscription software product accessible via web browser.

Eligibility

You must be at least 18 years old to use the Service. By using Risevu, you represent that you meet this requirement and that the information you provide is accurate and complete.

Accounts and Access

You are responsible for maintaining the security of your account credentials. You agree not to share your login with others or allow unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions and Billing

Risevu offers paid subscription plans billed on a monthly basis. All fees are charged in advance. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. No refunds are issued for partial billing periods. We reserve the right to change pricing with 30 days written notice to your registered email address.

Acceptable Use

You agree not to use the Service to upload or transmit unlawful, harmful, or fraudulent content; attempt to reverse engineer, scrape, or copy the Service; interfere with the security or integrity of the platform; or use the Service in any manner that violates applicable law. Violation of these terms may result in immediate account termination.

Your Data and Privacy

You retain ownership of all content you submit to Risevu, including win records, career data, and documents. By submitting content, you grant us a limited license to store and process it solely for the purpose of providing the Service. We will never sell your personal data to third parties. Intellectual Property

The Risevu platform, including its design, code, AI translation engine, and content framework, is owned by Everyday Creative Works LLC and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without express written permission.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Career outcome results described in marketing materials represent individual experiences and are not guaranteed.

Limitation of Liability

To the maximum extent permitted by applicable law, Everyday Creative Works LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Arbitration and Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Tarrant County, Texas, or remotely if agreed by both parties.

YOU AND RISEVU EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.

This arbitration clause does not apply to claims that qualify for small claims court or to requests for injunctive relief to protect intellectual property rights.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email to your registered address at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
